General terms and conditions of sale

The present conditions of sale are concluded, on the one hand, by the company GRAMMES EDITION with a share capital of 1000€ whose head office is located at 9 RUE DE LA CHAPELLE 53470 COMMER, registered with the Registre du Commerce et des Sociétés du greffe de Laval under the number Laval B 891 843 609 hereafter referred to as “GRAMMES EDITION” and managing the website www.clashofdecks.com and, on the other hand, by any individual or legal entity wishing to make a purchase via the website www.clashofdecks.com hereafter referred to as “the buyer”.

Article 1. Object

The present conditions of sale aim to define the contractual relations between GRAMMES EDITION and the buyer and the conditions applicable to any purchase made through the website www.clashofdecks.com. The acquisition of a product through this site implies an acceptance without reserve by the buyer of these conditions of sale which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site www.clashofdecks.com is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to commit himself under these general conditions of sale.

GRAMMES EDITION reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

The validation of your order implies acceptance without restriction or reservation of these General Conditions of Sale.

Article 2. Products

The products offered are those that appear on the website www.clashofdecks.com of GRAMMES EDITION, within the limits of available stocks. In the event that the order includes one (or more) unavailable product(s) as well as one (or more) product(s) already available, the entire order will be put on hold and will only be shipped when all products are available.

GRAMMES EDITION reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible but are not binding on the Seller. The sale of the products presented in the site www.clashofdecks.com is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Rates

For FRANCE and the countries of the EUROPEAN UNION, the prices appearing on the cards products of the catalog Internet are prices in Euros (€) all inclusive of tax (TTC) taking account of the VAT applicable to the day of the order. Any change in the VAT rate may be reflected in the price of the products. For all products shipped outside the European Union and to French overseas departments and territories, VAT will not be applicable but customs/import duties or other local or state taxes may be payable. These rights and sums are not under the jurisdiction of the Seller. You will be responsible for making all necessary declarations and payments to the appropriate authorities and organizations in your country or locality. We advise you to ask your local authorities about these aspects.

GRAMMES EDITION reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased, depending on the destination country of the buyer’s order.

In metropolitan France, a flat rate of participation in shipping costs will be charged to the buyer in the amount of 2.75 euros HT.

For all other countries of the world, a fixed price of 4.00 euros (excl. VAT) will be charged to the buyer for shipping costs.

Article 4. Order and payment terms

Before ordering, the buyer must create an account on the site www.clashofdecks.com. The account creation section is accessible directly from the sidebar. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile…), will have to identify himself with this information. GRAMMES EDITION offers the buyer the possibility of ordering and paying for products by secure payment via Paypal or credit card: the buyer selects the products he/she wishes to order in the “shopping cart”, modifies them if necessary (quantities, references…), checks the delivery address or enters a new one. Then the shipping costs are calculated and submitted to the buyer. Then, the buyer chooses the payment method of his choice: “Paypal” or “Popular payment methods”. The next step proposes to verify all the information, then invites him to validate his order by clicking on the “ORDER” button. Finally, the buyer is redirected to a secure interface in order to safely enter his Paypal account or personal credit card information. If the payment is accepted, the order is registered and the contract is definitively formed. The payment by Paypal account or by credit card is irrevocable. In case of fraudulent use of the card, the buyer may demand the cancellation of the payment by card, the sums paid will then be credited or refunded. The cardholder is not liable if the disputed payment was proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement for the fraudulent debit and any bank charges that may have been incurred, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or 120 days if the contract between the cardholder and the bank so provides. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the written objection made by the holder. The holder shall not be liable for any costs incurred in returning the sums.

The confirmation of an order implies acceptance of these terms of sale, the recognition of having perfect knowledge of them and the renunciation to take advantage of its own conditions of purchase. All the data provided and the recorded confirmation will be worth proof of the transaction. If the buyer has an email address and if he/she has provided it on the order form, GRAMMES EDITION will send him/her an email confirming the registration of his/her order.

Article 5. Reservation of ownership

GRAMMES EDITION retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.

Article 6. Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for return costs.

You must inform GRAMMES EDITION of your decision to retract by sending an email, before the expiration of the fourteen day period. You then have another 14 days to return the product(s) concerned at your expense by tracked or registered parcel with acknowledgement of receipt to the following address GRAMMES EDITION, 9 rue de la chapelle, 53470 COMMER, FRANCE.

The returned products must be in their original condition and complete (packaging, accessories, instructions …) allowing their remarketing in new condition, and accompanied by a copy of the invoice for optimal management. Items returned incomplete, damaged or soiled by the customer will be reimbursed with a discount relative to the deterioration of the product. Only the price of the products being the subject of a retraction will be refunded, the expenses of return remaining with your load. The reimbursement will be made within fourteen (14) days of GRAMMES EDITION receiving the returned products.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are prepared and shipped within 2 business days, Monday through Friday. The delivery times are only indicative and do not constitute a contractual document.

For shipments in France: the games are sent, depending on the weight and size of the order, via LETTRE ECOPLI (3-4 working days) or via COLISSIMO (48h to 72h – working days).

For shipments outside of Metropolitan France: the games are sent, depending on the weight and size of the order, via PRIORITY INTERNATIONAL LETTER (48-72h – working days) or via DELIVENGO (8 to 12 days – working days). When shipping to a country other than metropolitan France, you are the importer of the product(s) concerned. For all products shipped outside the European Union and DOM-TOM, the price will be calculated excluding VAT automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. They will be at your sole charge and are your sole responsibility.

In the event that the order includes one (or more) unavailable product(s) as well as one (or more) product(s) already available, the entire order will be put on hold and will only be shipped when all products are available.

The delivery times are only indicative and do not constitute a contractual document. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. GRAMMES EDITION will be able to provide the buyer with the tracking number of the parcel by e-mail in the case of postage with COLISSIMO or DELIVENGO.

The buyer is delivered to his home by his letter carrier. In case of absence of the buyer, he will receive a notice of passage of his factor, which allows him to withdraw the ordered products at the nearest post office, during a time indicated by the postal services. The risks related to transport are the responsibility of the purchaser from the moment the articles leave the premises of GRAMMES EDITION. The buyer is required to verify in the presence of the employee of the Post Office or the deliverer, the condition of the packaging of the goods and its contents upon delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

If the buyer selects the delivery option “Festival pick-up”, he/she will not benefit from a home delivery and must pick up his/her order at an event where GRAMMES EDITION is present.

Article 8. Warranty

All products supplied by GRAMMES EDITION benefit from the legal guarantee provided for in articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to GRAMMES EDITION who will take it back, exchange it or reimburse it. All claims, requests for exchange or refund must be made by email to the following address: info@grammesedition.fr, within thirty days after delivery.

Article 9. Responsibility

GRAMMES EDITION, in the process of distance selling, is only bound by an obligation of means. Its responsibility cannot be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of the service, or other involuntary problems.

Article 10. Intellectual Property

All elements of the site www.clashofdecks.com are and remain the exclusive intellectual property of GRAMMES EDITION. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether they are in the form of photo, logo, visual or text.

Article 11. Personal data

GRAMMES EDITION is committed to preserving the confidentiality of information provided by the buyer, which he/she may be required to transmit in order to use certain services. Any information concerning him is subject to the provisions of the law n° 78-17 of January 6, 1978. As such, the user has a right to access, modify and delete information about him. Article 12. Dispute Resolution

The present conditions of remote sale are subjected to the French law. For all disputes or litigation, the competent court will be the one on which the company’s head office depends.
